The "screens" where Google serves its ads are now the very interfaces of our minds, and if the content on those screens is unethical, our humanity itself is compromised.

To ensure this powerful technology benefits all and doesn't create a chaotic, unequal future, we cannot rely on outdated policy. We must be proactive. We need a new global operating system for the mind, and it starts with admitting where current regulation has already failed.

The Data Deluge and the Regulatory Deficit

The foundational problem with neurotechnology is that it deals with the most intimate, volatile, and valuable form of information imaginable: brain data.

Think about the data your phone collects. It knows where you go, what you buy, and what you search. Now imagine a BCI that knows not just what you bought, but the intention to buy it; not just what you searched, but the train of thought that led to the search query. This is the difference between digital data and brain data.

Why Brain Data is Unique and Dangerous

Inferred Data: Unlike an email (which you wrote and agreed to send), BCI data is often inferred. The G7/G20 Technology Working Groups: These groups represent the world’s largest economies and technology hubs. They must establish high-level BCI standards as a prerequisite for market access. If a BCI device isn't compliant, it simply can't be sold in these nations.

The United Nations Educational, Scientific and Cultural Organisation (UNESCO): UNESCO is crucial because it deals with ethics, education, and culture. They have already done foundational work in bioethics. Their role should be to establish and promote the globally recognised Neuro-Rights that protect human dignity.

The World Health Organisation (WHO): Since BCIs are often medical devices, the WHO must set global standards for clinical trials, long-term safety, and the proper, ethical use of these tools in healthcare settings.

The Actionable Goal: These groups must work together to create a Universal Declaration of Neuro-Rights, which is then codified into law by every cooperating nation. This is the first step toward a unified ethical front.

This pillar goes beyond simple "privacy" and addresses the issue of who owns the inferred data.

The Intentionality Rule: Any data derived from a BCI (neural recordings, inferred thoughts, emotional states) must be categorised based on user intention.

Intentional Data (Action): Data explicitly used to perform a function (e.g., moving a cursor). This is necessary for operation.

Latent Data (Passive): Data that is passively collected (e.g., emotional state, cognitive load). This data is automatically owned by the user and cannot be used for commercial purposes (advertising, personalised content) without a separate, non-revocable, highly specific data contract.

Mandatory Local Storage: Core, latent brain data should be stored on the device itself or locally with end-to-end encryption, with clear legal barriers preventing remote access by corporate servers unless mandated by law with a warrant.

Cognitive Autonomy and Identity Integrity (Protecting Mental Freedom)
